                                ORDINANCE NO. 9704
        
        
        
                   AN ORDINANCE TO AMEND CHATTANOOGA CITY CODE,
                   PART II, SECTION 11-377 TO INCLUDE A NEW
                   SUBSECTION (8) WHICH PROHIBITS SIDEWALK VENDING
                   ON THE CITY BLOCK WHERE THE ROSS'S LANDING
                   PLAZA IS LOCATED.

              	   WHEREAS, the City Council of the City of Chattanooga,
         Tennessee, is empowered to regulate all public grounds 
belonging
         to the City, and
              	   WHEREAS, the City Council of the City of Chattanooga,
         Tennessee, is empowered to pass all Ordinances necessary for 
the
         health, convenience, safety and general welfare of the
         inhabitants of the City, and
              	   WHEREAS, the City Council of the City of Chattanooga,
         Tennessee, due to the increase in the pedestrian and vehicular
         traffic caused by the Tennessee Aquarium, declares it is
         necessary to prohibit street vending on the block where the
         Tennessee Aquarium is located for the safety of all concerned.
                                 NOW, THEREFORE,
              	   BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
         CHATTANOOGA, TENNESSEE,
              	   SECTION 1.  That Chattanooga City Code, Part II,
         Section 11-377,  be amended to add a new subsection (8) as
         follows:

              	   (8)  Vend on any public right-of-way, including but
              not limited to the sidewalk area, on the city block which
              surrounds the Ross's Landing Plaza, more particularly
              described as that block which is bounded by Riverfront
              Parkway on the North, Chestnut Street on the West, 2nd
              Street on the South, and Market Street on the East.
        
              	   SECTION 2.  That this Ordinance shall take effect
         immediately, the public peace, health and safety requiring it.
